Got popped on my MC by oncoming radar:00000692: Well, I was going pretty fast, but not that much faster than the people in front of me, I just hadn't caught up to them yet and I was last in a long line of traffic. Well, you already know what they say about excuses...... Here's the question: I already looked it up and it counts as 1 point on my driving record. Here's my concern: Since I was 25 over, I'm worried that the insurance will look at that as reckless, or will they only see that it was a 1 point violation. Should I request a court date and hope the officer's radar wasn't calibrated? The fine was $400, because I didn't have proof of Registration or insurance, at the time, of course I have it:) Experiences of California SPEEDERS would be appreciated, oh, and of course, CHP and insurance folk too

Ernie sorry about the ticket, but it happens. In 30 years of law enforcement its the actual sped that means the most here. Technically speaking Calif law for reckless doesn't kick in till 100 mph or multiple violations at the same time, usually 3 or more. Most cops don't write 10+ over the limit, so I am sure the insurance isn't too worried about 25 over.

As far as fighting it goes, thats a choice that you have to make. Regarding the radar being calibrated if its CHP its probably calibrated, they make a fortune using them. They also are very good at showing up in court to testify, its overtime and its hard to come by these days:eek: If its a city PD its a maybe.

You also have to consider how much time off you have to take to go to court, it may cost you the ticket and some lost wages:frown: if you don't win. I'd call the court to see if traffic school is available for you. If so pay the fine go to school and avoid the insurance issue all together.

See California isn't all that bad after all, but then again they expect you to go fast here to keep up with everyone else:biggrin:

Up here a new law came into effect last month where if you are 40kph (25mph) over the speed limit your car gets towed on the spot and impounded for a week. By the time you get the car back and pay the fines its $1900. Second offence is more than double and so on. Suck it up, you were wrong, pay the fine. JMO

Had a state patrol pull me over for a slight overspeed a few years back,,I was caught, no doubt, no reason to argue. I watched him gun me and knew already before he even threw on the sex lights.

Asked him what the overspeed limit was,,or what he usually allows. 15mph over is a slam dunk,,your ticketed. 10 mph over is officers discretion. 7 mph over just means that you are paying attention and no need to hassle. This was Oregon State Patrol. Haden't had a ticket for many many years,, so he let me stay clean and no ticket issued. I was waaay out in the sticks on a lonely stretch,,so I am sure that played into his decision as well..

Last time I got a ticket the CHP wrote all 3 of us up for 78 mph in a 55 mph (the speedo on my bike was long since pegged (85 mph). I feel he gave us a break. I paid and did traffic school. That was 20 years ago. I rehooked up with my high school sweety at the lunch break. We married a year later and still married. I figure the next time I get a ticket I should get a mistress right?!?!?!?!? :happy0030:

Wow, what a response. I never said I wasn't wrong or that I wasn't going to pay the fine, just looking for options. Don't be ****** at me because laws up there aren't to your liking. Sure glad I didn't have any Cheerios laying around, jeesh:D
